A High Court judge has dismissed with costs a dispute over land in Harare’s high density suburb of Budiriro 4, which had degenerated into a nasty battle between apostolic sect members and their leader, Madzibaba Enock (Herbert Senda).
Herbert Senda, 37, the court said, is the rightful owner of the land.
He was involved in the land dispute with Clifford Chimusoro, Muchineripi Utete, Blessing Chimbadzo, Wellington Kadzutu and Taurai Munyika all of Budiro 4.
It is alleged that he five connived and sold the land without Madzibaba Enock’s knowledge.
The land originally belonged to Johanne Masowe YeChishanu Nyenyedzi Nomwe Housing Cooperative led by Senda, popularly known as Madzibaba Enock.
The court also heard that the five had no documentation or papers from the city council that showed they were the owners of the land.
Harare Lawyer Takunda Gombiro from ZENAS Legal practice represented Madzibaba Enock.
It is alleged the five duped unsuspecting home-seekers of US$500 000 (half a million RTGS$) in initial deposits and subscription fees and are no longer attending church services since then.
The five were also warned against bringing irrelevant issues and make false allegations on church leadership as some issues are a preserve for the church’s disciplinary department.
The land wrangle has been raging on since 2017.
