Darwendale – Chinhoyi Regional Magistrate Ignatius Mugove last week sentenced 18-year-old Moment Abudara of Mvebi Farm in Darwendale to five years imprisonment for aggravated sexual assault on a nine-year-old boy.
According to State Counsel Nyasha Sibesha, the court heard that on 27 February 2020, the complainant who was eight years then, was sent to Abudara’s home by his father to request some mealie cobs.
The two are neighbors at Mvebi Farm in Darwendale.
When the complainant arrived at Abudara’s home around 8 pm, he was dragged into a nearby room by the accused who went further to remove his clothes, ordered him to bend over and started sexually assaulting him. The boy who was screaming drew the attention of his 16-year-old sister who rushed to the scene and found Abudara in the shameful act.
The accused and his sister went and notified their grandmother and a police report at Darwendale Police Station was made.
The boy was medically examined at Kutama Mission Hospital and a medical report was produced in court showing that the boy was sexually assaulted.
Regional Magistrate Ignatius Mugove found Abudara who pleaded not guilty to the accusations, guilty of aggravated indecent assault as defined in section 66 of the Criminal Law (Codification and Reform) Act chapter 9:23) and sentenced him to five years imprisonment.
However, Abudara will serve an effective two years behind bars after three years of his sentence was suspended on condition of good behavior.
